This two-day workshop will provide participants with a comprehensive overview of 42 CFR Part 2, with a special focus on the legal and ethical reconciliation of this law with HIPAA, the Affordable Care Act, and other relevant State and Federal statutes and reporting/ data sharing mandates. America’s healthcare system is rapidly evolving and the boundaries of the traditional treatment system are blurring. In keeping with the mandates of the Affordable Care Act and emerging best-practice standards, the integration of behavioral health and primary care is quickly becoming the norm across the country. In Rhode Island and nearby Massachusetts and Connecticut, addiction treatment specialists, mental health counselors, social workers and psychologists now routinely provide care as part of an interdisciplinary team. Depending on the setting and modality of care, these interdisciplinary teams may also include physicians, nurses, community health-workers, peer and recovery support specialists, and many other allied health and wellness professionals. Participation on these teams also requires the reconciliation of historic interpretations of 42 CFR Part 2 and HIPAA with population health approaches; which by definition rely upon the sharing of protected health information between providers and across organizations. Through a variety of interactive group exercises, workshop participants will also explore the complex ethical, legal and moral issues facing today’s behavioral health workforce as it adapts to these new models of care.
