This workshop will provide participants with a detailed review of 42 CFR part 2, and a summative overview of HIPAA, the HITECH Act, and the CARES Act, with emphasis comparing the privacy-related requirements of 42 CFR to the mandates including other privacy-related federal statutes. They will be introduced to an evidence-based model that can be helpful when it is necessary to resolve privacy-related ethical dilemmas that may arise from time to time.

Objectives:

At the end of this webinar participants should be able to:

  1. Explain what is meant by the statement: “Informed consent discussions must meet the legal tests of being both ‘informed’ and ‘voluntary’ to be considered legally defensible.
  2. Differentiate the concepts of “Duty to Protect”, “Duty to Warn”, and “Mandated Reporting” and provide an example of each as they relate to behavioral health professionals.
  3. Explain how the use of an evidence-based ethical problem-solving model can assist counselors in resolving confidentiality related ethical dilemmas in a legally defensible manner.
