This workshop will provide participants with a detailed review of 42 CFR part 2, and a summative overview of HIPAA, the HITECH Act, and the CARES Act, with emphasis comparing the privacy-related requirements of 42 CFR to the mandates including other privacy-related federal statutes. They will be introduced to an evidence-based model that can be helpful when it is necessary to resolve privacy-related ethical dilemmas that may arise from time to time.
Objectives:
At the end of this webinar participants should be able to:
- Explain what is meant by the statement: “Informed consent discussions must meet the legal tests of being both ‘informed’ and ‘voluntary’ to be considered legally defensible.
- Differentiate the concepts of “Duty to Protect”, “Duty to Warn”, and “Mandated Reporting” and provide an example of each as they relate to behavioral health professionals.
- Explain how the use of an evidence-based ethical problem-solving model can assist counselors in resolving confidentiality related ethical dilemmas in a legally defensible manner.
